How do you plan to make it backwards compatible? HDCP, unlike DTCP, is either on or off. If you have a receiving device (e.g. HDTV) that does not have HDCP, do expect the transmitter to just turn HDCP off? If that is the case, then there is no point in having HDCP at all (which is not a bad thing in itself). A user with a device that has HDCP can buy a simple tool that blocks the transmitter from reading the HDCP EDID and thus the HDCP enabled device now looks like a non-HDCP device and by your suggestion HDCP is turned off and thus spoofed.
Good luck with your effort, but the FCC is getting a lot of pressure from the MPAA and NAB for this and the dreaded Broadcast Flag (a.k.a. the content redistribution descriptor). CBS has actually threatened to start pulling HD content should these issues not get resolved in the near term.
