You can now, the Series 3 Tivo, still need to rent cablecards for it though. I don't think you'll ever be able to buy a standard cable box outright, just cablecard enabled boxes.

All US cable service providers require you to rent the STB/DVR from them, however the rental rates are quite reasonable.
CableCARD equiped STBs/DVRs will be coming to market now due to FCC regulations July 1, however, they will not likely work out any less expensive and CableCARD doesn't currently allow for 2-way communications (VOD, etc)

As mjones73 indicated, a CableCard equipped DVR has been on the market for over a year now.
